Dead Kings DLC Removes your right to Sue Ubisoft over AC Unity Issues

Remember how Ubisoft offered that free game to everyone that had issues with AC Unity? Well despite many people thinking that this was to make things right it was really all about making sure that Ubisoft did not end up the target of a law suit. According to multiple sources on the internet there is verbiage in the EULA that says you are giving up any and all rights to sue Ubisoft over the issues present in AC Unity. To call this a jackass move on the part of Ubisoft is something of an understatement.

A review of the Dead Kings DLC EULA shows the following line:

“You hereby irrevocably and unconditionally RELEASE, WAIVE, AND FOREVER DISCHARGE AND COVENANT NOT TO SUE Ubisoft Entertainment S.A., and each of its past, present and future divisions, parent companies, subsidiaries, affiliates, predecessors, successors and assigns, together with all of their respective past, present and future employees, officers, shareholders, directors and agents, and those who give recommendations, directions, or instructions or engage in risk evaluation or loss control activities regarding the Campaign (all for the purposes herein referred to as “Released Parties”) FROM ANY AND ALL LIABILITY TO YOU, your assigns, heirs, and next of kin FOR ANY AND ALL CLAIMS, DEMANDS, CHARGES, LAWSUITS, DEBTS, DEFENSES, ACTIONS OR CAUSES OF ACTION, OBLIGATIONS, DAMAGES, LOSS OF SERVICE, COMPENSATION, PAIN AND SUFFERING, ATTORNEYS’ FEES, AND COST AND EXPENSES OF SUIT, KNOWN OR UNKNOWN, SUSPECTED OR UNSUSPECTED, ARISING OUT OF OR RELATED TO THE PURCHASE, ACQUISITION, RENTAL, POSSESSION AND/OR USAGE, AND/OR THE INTENT TO PURCHASE, ACQUIRE, RENT, POSSESS AND/OR USE, THE ASSASSIN’S CREED UNITY VIDEO GAME AND/OR THE ASSASSIN’S CREED UNITY SEASON PASS ON ANY AND ALL PLATFORMS, AND/OR RELATED TO THE CAMPAIGN, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE.”

So this means that no matter what your (or anyone else’s) plans are to get your money back or to get something for that headache and pain that AC Unity was/is, if you grab this DLC you are done. Ubisoft is making it very clear that they are squashing your right to litigation with a DLC offer. In my opinion this sounds like they know they are vulnerable to legal action and want to remove as many people as they can in a big hurry. They can bank on a few thousand people doing this because very few (if any) people read the license agreements on their software anymore. It is an underhanded move, but really not unexpected from a company that would knowingly release a game that was a broken as AC Unity was. Ubisoft has had a string of problems with releasing half-baked games with AC Unity just being the biggest blunder.

It is sort of sad that Ubisoft is going this route and not just taking care of the end users that support them by buying their products. If you are one of the people that bought AC Unity we hope that you read anything that comes from them very carefully before you agree to it, you might be signing away your rights to get your money and time back…
