Yesterday we reported that Apple had lost a big to toss out a patent suit aimed at their iPhone and iPad in China. This was quite a blow to the company that has made China its manufacturing home. Normally Apple can get its way when dealing with patents simply because of the mythology they have created.  However this has not always held up in China as we have seen multiple decisions go against Apple.

Apple is having a rough time in China again and the situation seems very ironic to many following is (not to mention the whole Karma angle). In 2012 a Chinese company by the name of Zhizhen filed a patent infringement suit against Apple claiming the iThing maker violated their patent on voice related technologies. Zhizhen uses this technology in their Xiao I Robot software and Apples inclusion of Mandarin and Cantonese violates their rights on this technology.

In a somewhat surprising decision the US Supreme Court has rules that patents that cover an “abstract idea” are not valid. This was the final outcome of a battle between two financial institutions, Alice Corp and CLS Bank. The story is one that has played out very often, Alice Corp. holds the patent for the concept of an electronic escrow system. CLS wants to use the same type of system, but as the patent held by Alice Corp is so vague and abstract they cannot do so without running the risk of infringing.

There is another rumor of a buy out on the net. This time the company up in the display window is Nuance. If you do not know who these guys are you at least know some of the products their technology is in. Nuance develops speech recognition and voice technology. They are in Apple’s Siri and Samsung’s S-Voice products (they are in many others as well).

This morning’s news is full of posts about Google “following” Apple into the wearable fitness game. After Apple announced their Healthkit app and all that it can do Google quickly pulled the covers back on theirs. Now what all of these articles fail to mention is that other companies have been in the health game long before Apple decided to step into the waters. Nike, Polar, I’M Spa, and Even Samsung had health apps and wearables long before.

So Apple could finally be entering the Smartwach fray this year. At least that is the current rumor and push from Analysts. If this is true it will be a big deal for both Apple and Tim Cook as this will be the first new product type since the introduction of the iPad. Tim Cook has even more riding on this than Apple does as it will be a make or break deal for him to show that he is capable of leading Apple into new markets and not just refreshing the same devices over and over.

iPhone 6 in sales from September 19

Rumors about the new iPhone are coming from all over the internet. First, the Taiwanese media unearthed information that the new Apple smartphone should be launched in August this year, earlier than usual. However, Apple is a company known for keeping the tradition, so they will probably not do something out of ordinary this time.

Irony is described by Miriam Webster as: a situation that is strange or funny because things happen in a way that seems to be the opposite of what you expected. This is exactly what we have in the current (and immature) market for the smartwatch. Although we have heard Apple’s PR and legal teams cry that Samsung copies everything they do (Tim Cook once claimed Apple as the sole source of innovation) it seems that Apple is falling behind the company that some Apple fans dub “samesung”. At least this is the case in the Smartwatch market.
